The acceptance of these general user conditions is essential for purchasing works of art through Proyecto Din A3.
These general user conditions apply, without restriction or reservation, to sales made on the Proyecto Din A3 platform, located at Paseo de los Basilios nº10, 18008 Granada, to customers who purchase the works exhibited through the website.
The sales held are distance sales regulated by current Spanish legislation on the matter.
These general sale conditions are accessible at all times from the website and will prevail over any other document they contradict without prejudice to current legislation.
The validation of the order by the customer implies the unreserved acceptance of these general user conditions. Should general user conditions change, they will be binding for all purchases made after their publication on the website.

Din A3 acts as a gallery, exhibiting works of art by the artists on the platform https://www.proyectodina3.com/. Proyecto Din A3 has the authorization of the authors of the artworks to facilitate their acquisition through their website and to sign the terms of these conditions.
Although the reproductions of the works of art that appear on this platform are as reliable as technological means allow. The colours may not be exactly the same due to the monitor colour display and depending on the monitor’s settings. Therefore, there may be colour variations with respect to reality, slight millimetre variations in the measurements, or minimal image distortions.
The conditions that the user accepts for the acquisition of works of art are:
A legal agreement between the user and Proyecto Din A3.
The user declares and guarantees that he is 18 years old or older and acts in his name and right, thus having the legal capacity to accept the user conditions.
The user declares that the information and data provided are accurate and authentic, including, without limitation, bank card details or other bank details.

Shipments for sales in Spain and outside of Spain carry a cost as a supplement. Shipping expenses can be consulted when purchasing once the item has been added to the cart, automatically adding to the amount of the selected work or works. The customs and / or tariff or import / export costs of each country will be borne by the user.
The purchase system is subject to current Spanish legislation. Therefore, sales operations will be understood to be carried out at the registered office of Proyecto Din A3.
If the work is received in poor condition for any reason, you must send an email to Proyecto DinA3 within a non-extendable period of 24 hours from receipt, indicating the incident.
Intellectual property rights protect the work of art. In the case of items that can be copied, the user may return the work of art as long as it is not damaged by improper use. Purchase and shipping:
Once the purchase of the work of art is formalized, Proyecto Din A3 undertakes to deliver the artworks to the client with a guaranteed courier service, and they will be received within seven working days from their payment, although eventually, for reasons beyond our control. , the service can be provided within 28 days after your online purchase. For example, if the delivery address provided by the customer is not correct, the shipment may be delayed until the incident is resolved. In addition, the customer can enter a different address for billing than the shipping address.
The effects produced by strikes, armed conflicts or other unforeseeable circumstances and/or beyond its control will not be attributable to Proyecto Din A3. Proyecto Din A3 will not be responsible for delays in customs clearance or the confiscation of any item contained in a shipment by local authorities. As long as the contrary is not agreed, the delivery will be made at the address communicated by the customer. Proyecto Din A3 is not responsible (and the user expressly exempts Proyecto Din A3) from the consequences or possible damages that may have been caused to the user due to computer technical failures that occurred on the internet server where it is hosted. Shipping costs for all exported products are based on weight, measurements and delivery destination. If a customer purchases multiple works of art, Proyecto Din A3 is entitled to partial deliveries at no additional cost to the customer.
In the event that the delivery of the work is not possible during the 30 days following its shipment, for reasons attributable to the user, and it is returned to its origin, the client will bear the costs of a second shipment of the same.
Payment Methods:
Payments will be made through credit or debit card using the payment gateway inserted in www.proyectodina3.com. It is a secured payment through PayPal that accepts credit cards: Visa, Mastercard, American Express, and debit cards: Visa Electron, Mastercard Maestro and American Express.

Warranty:

In compliance with the General Data Protection Regulation (hereinafter, RGPD), we inform you that at DinA3 we treat the information you provide us with to provide the requested service and carry out your billing. The data provided will be kept as long as the business relationship is maintained or for the time necessary to comply with legal obligations and meet the possible responsibilities that may arise from the fulfilment of the purpose for which the data was collected. The data will not be transferred to third parties except in cases where there is a legal obligation. Intellectual property:
Proyecto Din A3 is the exclusive owner of all intellectual property rights related to the development of the platform and its contents unless expressly stated otherwise. The website, brands, designs, models, images, texts, photos, logos, graphic designs, software, as well as programs, search engines, databases, sounds, videos, domain names, design and any other content available on the platform, with the exception of the images, texts and photos provided by the AUTHOR / A, and although this list is not exhaustive, they will be the exclusive property of Proyecto Din A3 and will be protected by current provisions on copyright, trademarks, patents and any other intellectual or industrial property rights.
Copyright:

Any controversy regarding the violation of copyright must be resolved between the owner of such rights and the person who acquires his work of art, in any case, and under the express agreement of the acquirer.
The User understands that the work of art acquired through Proyecto Din A3 and its images are protected by copyright, and therefore any unauthorized use of the same will be considered as a violation of those rights.
The user must defend, indemnify and release Proyecto Din A3 from responsibility for any damages, obligations and expenses (including reasonable attorneys’ fees and permitted and authorized costs) arising from any claim filed by a third party in relation to the improper use by the user of intellectual property rights and copyrights; as well as those deriving from the breach by the user of this agreement.
Nullity of one or more matters contained in these general conditions: In the event that, regardless of the cause or manner, a clause or pact of this agreement is considered null or not enforceable, said nullity or unenforceability will not affect the validity or enforceability of the remaining provisions in the agreement. The clause in question will be complied with to the extent permitted by law.
Force majeure: In the event of force majeure, the execution of this agreement will be suspended. Force majeure or fortuitous cases will be considered, which are usually interpreted by Spanish legislation and jurisprudence.
Applicable legislation: This agreement will be governed by Spanish legislation, regardless of the place of fulfilment of the obligations derived from it.
Express submission:
In the event of doubts or discrepancies in the interpretation or execution of the agreement, the parties, waiving any other jurisdiction, expressly submit to the Courts and Tribunals of Granada.
